Payment

We accept Delta, Maestro, Mastercard, UK Maestro, Visa, and Switch. Payment is taken at the time of placing the order via Wix or PayPal. As card payments for online orders are made via Wix or PayPal, which are extremely secure web payment system, Norast Ltd trading as Norast Supply do not have any access to your card details.

Pricing
If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at the new price.

Liability
There are certain liabilities which we cannot exclude by law, and nothing in these General Terms and Conditions limits our liability for personal injury or death caused by our negligence or for fraud.
You have certain rights as a consumer, including legal rights relating to faulty or misdescribed goods. For further information about your legal rights in the UK, contact your local authority Trading Standards Department or Citizen’s Advice Bureau. Nothing in these General Terms and Conditions will affect these legal rights and, in particular, we will perform our obligations under these General Terms and Conditions with reasonable care and skill.
Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, you can contact us for a repair or replacement or, where this is not possible, for a refund.
We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms and Conditions. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms and Conditions by anything you (or anyone acting on your behalf) does or fails to do or due to events which are beyond our reasonable control.
You must follow any advice we give you to keep products we supply to you safe (including any instructions or product manuals provided with the products). We cannot accept liability for damage to products we have supplied that is caused by your failure to follow this advice.

We will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption due to the inability to access a delivery location because of Port Authority or any other body not granting Norast Ltd trading as Norast Supply or any of our delivery partners access to the delivery location. Nor will we be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption due to any error with customs procedures.

In any event we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.
Assignment, waiver and third party rights
We may update or amend these General Terms and Conditions of Sale from time to time to comply with law or to meet our changing business requirements without notice to you. Any updates or amendments will be posted on the Website.
You may not assign or sub-contract any of your rights or obligations under these General Terms and Conditions of Sale to any third party, unless we agree in writing.
We may assign, transfer or sub-contract any of our rights or obligations under these General Terms and Conditions of Sale to any third party at our discretion.
No relaxation or delay by us in exercising any right or remedy under these General Terms and Conditions of Sale shall operate as waiver of that right or remedy or shall affect our ability to subsequently exercise that right or remedy. Any waiver must be agreed by us in writing.
If any of these General Terms and Conditions of Sale are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these General Terms and Conditions of Sale shall remain in full force and effect.
Only you and we shall be entitled to enforce these Terms of Sale. No third party shall be entitled to enforce any of these Terms of Sale, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.
These General Terms and Conditions of Sale are governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Delivery

We aim to despatch goods within 3 working days of your order and in the timeframe you provide with your ETA & ETD.
All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.
We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.
The majority of our deliveries will be made via our delivery partners. A signature will be required.
In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Consumer Protection (Distance Selling) Regulations 2000 and other applicable legislation. Similar rights may apply for some international deliveries. For further information about your legal rights see “Your Right to Cancel” section below and contact your local authority Trading Standards department or consumer advice centre (for example the Citizen’s Advice Bureau for UK customers).
Norast Ltd trading as Norast Supply deliver within the UK only.

You confirm that the information relating to your ship (Ship name, Delivery port, IMO Number, Shipping agent information, ETA, ETD) is correct and any wrong information can lead to the non delivery of your goods. Any re-delivery will be charged at your expense.

We will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption due to the inability to access a delivery location because of Port Authority or any other body not granting Norast Ltd trading as Norast Supply or any of our delivery partners access to the delivery location.
​
No deliveries can be made to vessels that are not in a UK* Port. *We cannot deliver to vessels that are located in Northern Ireland.
​
Norast Ltd trading as Norast Supply are not liable for any fees/charges that are imposed for landing/delivering stores at the delivery port.
​
Provided the prevailing circumstances reasonably permit, Norast Ltd trading as Norast Supply shall supply and deliver to the Purchaser the Goods or Services as ordered at the time and place stipulated by the Purchaser insofar as Norast Ltd trading as Norast Supply has agreed to do so and such Goods or Services are available at the agreed port or port-area.

Norast Ltd trading as Norast Supply responsibility for transport of the Goods shall end at the nearest point to the Vessel that the delivery vehicle(s) may, with the necessary authority, reach (“the Point of Delivery”).
​
Should Norast Ltd trading as Norast Supply expressly agree to transport/handle the Goods beyond the Point of Delivery as defined in paragraph the costs of such additional delivery/handling shall be agreed in advance.
​
If delivery is requested outside the normal hours of the agreed port or port-area or on Saturdays, Sundays or religious or national or legal holidays, expenses incidental to such delivery shall be payable by the Purchaser as additional costs. Transport Costs shall be invoiced and payable by the Purchaser.

The Goods shall be deemed delivered on the arrival of the Goods at the stipulated time at the Point of Delivery. The responsibility, cost and risk of unloading the delivery vehicle(s) and delivering on board are for account of the Purchaser. Risk in the Goods (but not property therein) shall, in all respects, pass to the Purchaser upon delivery.

The Purchaser shall pay to the Vendor any costs or expenses incidental to any waiting period beyond a reasonable time.
​
All orders and receipt notes will be signed by the master or his authorised representative.
​
Where Norast Ltd trading as Norast Supply is requested to deliver Goods other than to the Vessel responsibility rests with the Purchaser to ensure that the person responsible for accepting delivery gives a full and proper receipt for the Goods delivered. Signed receipt by that party shall constitute acceptance of delivery by and to the Purchaser.
Contract
​
When you place an order, Norast Ltd trading as Norast Supply accepts this as an invitation to purchase only. Any confirmation of receipt of your order is not a guarantee that the goods will be supplied. Norast Ltd trading as Norast Supply reserve the right to cancel your order if we have insufficient stock, cannot deliver to the specified delivery address, or the product was listed at an incorrect price. Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found, Norast Ltd trading as Norast Supply will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, Norast Ltd trading as Norast Supply will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
Where part of an order has already been delivered, this does not mean Norast Ltd trading as Norast Supply is obliged to supply outstanding products if they fall into the above categories. Every reasonable care has been taken to ensure that the descriptions are accurate, however with constant product development, specifications may change without notice.

Claims and Liability
​
Subject only to the Condition in the paragraph below, by taking delivery of the Goods and signing the accompanying receipt-note, the Purchaser shall be deemed to have approved and accepted the Goods in every respect.
Any claims with regard to the conformity or quality of the delivered Goods must be notified in writing to Norast Ltd trading as Norast Supply within 8 days from delivery and in the absence of such notification the Purchaser shall be deemed to have approved and accepted the Goods in every respect. Exception is made in the case of fresh products and perishable Goods, for which claims must be notified in writing at the time of delivery or as soon as practicable thereafter. Where a claim is made in accordance with the provisions of this paragraph and where such claim is accepted by Norast Ltd trading as Norast Supply the Purchaser shall be entitled to a refund of the price of the affected Goods upon inspection of said goods by Norast Ltd trading as Norast Supply or as otherwise agreed in writing by the Parties.
In the event of a claim pursuant to the above paragraph the Purchaser shall be required to prove that,
since delivery, the Goods were continuously handled, treated and stored by the Purchaser as a prudent administrator in keeping with the nature of the Goods and their propensity to deteriorate and that any alleged deficiency is not attributable to the Purchaser’s fault or negligence. The Purchaser shall be required to make the Goods under claim available for inspection.
Save for claims for death or personal injury any damages/compensation shall be strictly limited to a refund of the price paid to or charged by Norast Ltd trading as Norast Supply for the affected Goods or Services. Norast Ltd trading as Norast Supply shall not under any circumstances whatsoever including Norast Ltd trading as Norast Supply negligence be liable for any claim for consequential loss, damage or injury arising out of the supply, or late supply or failure to supply, of any Goods or Services. Norast Ltd trading as Norast Supply shall not be liable for the financial consequences arising from any delay to the Vessel or any period that the Vessel may be off-hire or otherwise unable to earn.
Any complaint by the Purchaser with regard to Norast Ltd trading as Norast Supply invoice will be absolutely barred unless lodged in writing by the Purchaser with Norast Ltd trading as Norast Supply at Norast Ltd trading as Norast Supply usual business address within 8 days of delivery of the invoice.

Please be aware that all images on the Norast Supply website are used for illustration purposes only and, whilst we do our best to provide an accurate image of the product, sometimes a supplier will send a generic shot.
Our product description should be the main source of information if available and, if you feel there is a discrepancy between the two, please bring it to our attention before making the purchase.

Tax Charges (VAT)

NO VAT is payable on items listed on www.norastsupply.com. Norast Ltd trading as Norast Supply is not a VAT registered business.
Force Majeure
​
If Norast Ltd trading as Norast Supply is unable to make delivery, or to make delivery in good time, owing to force majeure (which shall include all or any circumstances or conditions for which Norast Ltd trading as Norast Supply cannot be held responsible and as a consequence whereof it is not reasonably possible to make delivery in good time or at all) then Norast Ltd trading as Norast Supply obligation to deliver shall cease or if appropriate be suspended for the duration of such force majeure.

Law and Jurisdiction
​
1a. Subject always to clause 1d any dispute arising out of or in connection with any Contract subject to these Conditions, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in England and governed by the Arbitration Act 1996. Any such arbitration proceedings shall be before a sole arbitrator who shall be appointed by the claimant, who shall be a shipping lawyer qualified to practice law in England.

1b. Notwithstanding the commencement of arbitration proceedings Norast Ltd trading as Norast Supply shall be entitled to commence proceedings in any other jurisdiction or before any court in order to obtain security for its claim, including security for interest due and legal costs to be incurred.
​
1c. Notice of arbitration shall be validly served if sent to one or more of the email addresses, fax numbers or physical addresses used or identified by the Party served during the course of their prior business dealings.
​
1d. Norast Ltd trading as Norast Supply shall be entitled at any time prior to the commencement of arbitration proceedings pursuant to clause 1a to commence substantive proceedings against the Purchaser, its assets including the Vessel or any sister or associated vessel in the court of any jurisdiction where the Purchaser may be located, domiciled or present or where any assets, including its Vessel or sister or associated vessel may be located. In the event that Norast Ltd trading as Norast Supply exercises that option then neither Party shall be entitled to commence arbitration proceedings and any disputes must be submitted to the court at which the Vendor has commenced proceedings.

1e. All contracts entered pursuant to these Conditions shall be subject to the laws of the Southern District of California, USA. The United Nations Convention on Contracts for the International Sale of Goods (Vienna UNCITRAL Convention on International Trade Law, also known as the Vienna Treaty)
is excluded from application.
